Activision’s name has come up in a class-action suit that accuses the publisher of “deceptive and unlawful” conduct. Activision is being blamed for releasing the Wii edition of Guitar Hero III with mono sound and not Dolby Pro Logic II surround sound, as claimed on the box .

The suit, brought by plaintiff Samuel Livingston of San Diego and represented by the law firm KamberEdelson, LLC, “seeks actual damages, individual restitution, equitable relief, civil penalties, costs and expenses of litigation, including attorney’s fees, and all further relief available.”

The suit continues to hit Activision for not addressing this problem or taking any steps as to warn future purchasers about the issue.

Last week Activision stated that replacement discs will be issued for Guitar Hero III Wii, but no sooner than next year (which is right around the corner).

As far as the lawsuit goes, an Activision rep said the company “cannot comment on any on-going litigation.”
